Terms and conditions of hire
- The person by whom the booking form is signed shall be deemed to be the lessee.
- The subjects of let (hereinafter referred to as ‘the subjects’ shall be used only for the purpose intimated on the booking form by the lessee, and no other purpose whatsoever.
- The lessee shall have attained the age of eighteen (18) years by the date upon which the application is made.
- The committee reserves the right to refuse any application.
- A provisional booking must be confirmed no later than seven working days after the date said provisional booking is made, otherwise the provisional booking will be automatically cancelled. The committee shall not be liable for any loss whatsoever caused thereby.
- The committee reserved to right to ‘stand down’ any group, organisation or individual making regular use of the facilities in order to make way for any let the committee deem necessary. In such an event, the lessee will be offered full repayment of fee paid to the committee for the let, if paid in full, or at the option of the Committee, a mutually acceptable alternative date or venue. The Committee shall not be liable for any loss whatsoever caused thereby.
- In the event of cancellation by the lessee, an administrative charge may be levied and that charge will be determined by the length of notice given. Within one week – 50% charge. Within two weeks – 25% charge. For all functions there will be £100 deposit. The lessee will be charged for the times stated on the booking form regardless if there is an early exit. An additional time will be charged.
- Certain types of lets, for example those which include discos, live bands and lets of an extraordinary nature may be subject to additional terms and conditions as the Committee may think fit.
- Notwithstanding the terms of Clause 6 above, the Committee may cancel a booking at any time. In the event, the lessee shall be entitled to the return of the full amount paid by way of hiring charge. The Committee shall not be responsible for loss or expense howsoever incurred by the lessee or any third party in consequence of such cancellation.
- The Committee shall not be responsible for any loss to the lessee or any third party due to any circumstances whatsoever, whether or not caused by negligence on the part of the Committee which may cause the subjects to be closed or the hiring thereof to be interrupted, postponed, cancelled or adversely affected in any way.
- The Committee shall not be liable for any loss or damage to property situated in or around the subjects, belonging to the lessee or third parties, or for any loss, damage injury or death arising as a result of any activity or activities carried out in, or around the subjects by the lessee or third parties. The lessee shall indemnify the Committee in respect of any such claims for the loss, damage injury or death.
- The lessee shall indemnify the Committee against damage to the subjects and fittings, fixtures or equipment therein, caused during the period of let or arising for the let.
- The appointed authorised Officer shall at all times be given full access to all parts of the subjects during the period of let and shall have authority to issue instructions to the lessee in order to ensure compliance with regulations governing any let. The lessees shall comply with all these said instructions.
- No dramatic, musical or other work over which there is copyright shall be performed without the written permission of the holder or the said copyright and all such permissions shall be produced on demand to the appointed officer. The Committee reserves the right to recover charges in part or in while on behalf of the Performing Rights Society, Phonographic Performance Ltd and Video Performance Ltd.
- Any alcoholic liquor bar shall be under the control of the licensee whose decision on all matter relating to the dale of excisable 1 shall be final. The licensee shall comply with all conditions of the relative license granted by the appropriate Licensing Board.
- The lessee shall ensure that the maximum number of persons, including staff, permitted in the subjects does not exceed the number prescribed by the committee.
- No articles, materials, solid, liquid or gaseous, or equipment shall be brought in the subjects which would be likely, in the opinion of the caretaker, to cause damage to the subjects or to plant machinery, equipment, fittings and fixings, therein nor shall nails, tacks or anything whatsoever be driven into attached to the fabric of the subjects, including the floor, without prior written authority of the committee.
- No inflammable or combustible substances shall be allowed within the subjects without prior written consent of the Committee.
- Prior to the commencement of the let, the lessee must be satisfied with the condition of the subjects and the efficiency of the equipment therein. This will include familiarisation with the Committee’s emergency regulations relating to the premises. The Committee shall not be responsible for loss, damage, injury or death suffered by the lessee or any third parties through failure of equipment within the subjects. The lessee shall comply with any management rules which apply to the subjects.
- The lessee shall provide a sufficient number of competent stewards where it is deemed necessary to preserve order both within and out with the subjects.
- Smoking is forbidden in all areas within the Complex.
- The subjects must be cleared by the finishing time stated on the booking form and all appropriate equipment, including beer facilities, must be removed promptly. Failure to do so shall result in a penalty of up to £100 may be applied if this is not adhered to.
- The Committee reserves the right to amend all charges without prior notice to the lessee. An annual review of charges shall be implemented on 1st April each year and the new charge shall be applied to all lets occurring thereafter notwithstanding that the booking may have been made prior to the review.
- Notwithstanding the foregoing generality, in the event of any breach of non-compliance with all or any of the above conditions, it shall be at the Committee’s option to terminate the let with immediate any deposit paid or any combination of the foregoing. This is without prejudice to the right of the Committee to take legal action in respect of any such violation.
- Data Protection – Your information is important to us. We will use your data to contact you about your booking. We will not use your data to send you marketing information. We will keep your data for the period of your booking and for twelve months after. We will not share your data with any third party without lawful basis. Your data will be kept securely and only a limited number of staff will have access to it. We will review our policies and procedures regularly to make sure your data is always protected.
